Overview

Mabvuto Sakala is the managing partner of our Zambia office and a member of the Corporate Investigations Practice.

He specialises in corporate litigation, alternate dispute resolution, employment, and corporate investigation and has acted on some of the country’s most complex and high-profile commercial litigation and arbitration matters.

He is currently acting in two ICC arbitrations for a mining company involving a mining service contract and a copper refinery construction contract.

Mabvuto’s experience extends to banking, mining, energy, and financial services. He continues to act for leading commercial banks on class action claims involving pensions and employment benefits.

Recently, he has been breaking frontiers in the corporate investigations space, particularly as jurisdictions continue to adopt laws to ease doing business and align with global regulatory best practices, leading to increased oversight by regulators as well as a renewed focus on ethical behaviour, environmental, social, and governance (ESG), data protection and privacy, and protecting, among other things, and as most of his clients adapt and increasingly focus on potential breaches or non-compliance with their policies, procedures, processes, frameworks, code of conduct, or other internal directives that govern them.

Barclays Bank Zambia Plc, one of the country’s largest employment class action claims involving pensions and employment benefits with an estimated settlement value of ZMW 400 million (est. USD 33.2 million), the biggest ever awarded against the Respondent;
  • Absa Bank Zambia Plc, as respondent in the matter ZUFIAW v. Absa Bank Zambia Plc, where the Zambia Union of Financial Institutions and Allied Workers (ZUFIAW) is demanding payment of redundancy packages and accrued employment benefits following the change in shareholding in Barclays Africa Group Limited, the parent company of Barclays Bank Zambia Limited;
  • Public Service Pension Fund Board (PSPF), a public pensions management and administration organisation, as respondent in the matter Namangolwa Mateele v Public Service Pension Fund Board, a class-action claim involving redundancy payment and employee benefits with a potential exposure of approximately ZMW 20 million;
  • Solarquest Zambia Limited, a renewable energy company, as respondent in the matter Jinko Solar Company Limited v Solarquest Zambia Limited where Jinko has initiated business rescue proceedings in Commercial Division of the High Court of Zambia;
  • Barloworld Logistics (Pty) Limited, a part of Barloworld Group Limited, an industrial processing, distribution, and services company in the matter Frederick Mwale and 51 Others v Barlowold Logistics (Pty) Limited where former employees have sued Barloworld for entitlements accrued while in its employ.
