Overview

Kelly is an associate in the Litigation Practice within the Dispute Resolution Department of our Johannesburg office.

She has experience in general commercial litigation, contractual and delictual claims, and constitutional and administrative law. In addition, Kelly has worked on various matters concerning employment, pensions and benefits issues. Her experience includes both trial and motion proceedings, as well as private commercial arbitration.

Kelly is an admitted attorney of the High Court of South Africa and has BA and LLB degrees from the University of Cape Town.

Experience

  • Assisted in acting for various corporate entities in general commercial litigation.
  • Acting for a multinational corporation against the South African Government in respect of the lockdown regulations imposed as a result of the Covid-19 pandemic.
  • Assisted in defending a leading South African retailer in an equal pay dispute lodged against it before the Commission for Conciliation, Mediation and Arbitration.
  • Assisted a large state-owned company in an urgent application, made together with the Special Investigations Unit, to the Special Tribunal for various restraint and preservation orders following successful findings of corrupt activities by an employee.
  • Assisted the Public Servants Association of South Africa in its appeal to the Constitutional Court, concerning the enforcement of a collective wage agreement.
  • Assisted Old Mutual in various litigation against its previous chief executive officer, including successfully defending his ZAR 250 million damages claim against Old Mutual.
  • Assisted a homeowners’ association with a plethora of litigation against a community Trust, emanating from a land claim.
