Overview

Kate Paterson specialises in public law advice and litigation.

She has wide-ranging experience in constitutional and administrative law, including advising and litigating on public procurement, public-private partnerships, data protection and privacy, broad-based black economic empowerment, the rights to education, health and the environment, children’s rights and land reform.

She regularly advises on the Public Finance Management Act, the Municipal Finance Management Act and associated regulatory frameworks and represents organs of state and private companies in complex procurement-related disputes.

Prior to joining Bowmans, Kate practised at a public interest law centre in Johannesburg and clerked for Justice Edwin Cameron at the Constitutional Court of South Africa.

  • Eskom Holdings SOC (Ltd) on various public procurement reforms and recovery efforts arising from state capture, including a number of civil litigation matters.
  • The Department of Home Affairs on the procurement of a private sector party through a public-private partnership to redevelop certain key land ports of entry.
  • The City of Cape Town in relation to the appointment of a carrier network service provider and sales partner to give effect to its Broadband Infrastructure Project.
  • Several international clients on the establishment of independent schools and tertiary institutions in South Africa.
  • A listed company on multiple complex judicial review applications regarding a Broad-Based Black Economic Empowerment certificate and a related complaint to the B-BBEE Commissioner.
  • Private companies and industry bodies on the scope and effect of COVID-19 regulations, including the provision of emergency health facilities and the procurement of vaccines.
