Overview
Kara van de Pol is a consultant in our Dispute Resolution Department and a member of the Corporate Investigations Practice.
The greater part of her practice involves resolving commercial and contractual disputes. But as part of a team that has a special focus on business rescue & insolvency, Kara has advised companies seeking to enter into business rescue – as well as the shareholders, directors and creditors affected by the process. She has also acted for business rescue practitioners – including, in one matter, for those appointed to supervise the rescue of a company listed on the JSE’s Alt-X. She has represented a number of creditors and liquidators in insolvency proceedings and enquiries.
Kara was admitted as an attorney in 2010.
Experience
Kara has in recent years also advised on:
- applications to declare a director delinquent;
- restraint of trade agreements;
- unlawful competition;
- disputes between parties in partnerships;
- general contractual disputes (such as between commercial landlords or developers and tenants, between shareholders and directors, between sellers and purchasers, between manufacturers and distributors, and between contractors and sub-contractors); and
- defamation claims.
Her clients have ranged from commodity traders, property developers, gym chains and accounting firms – to statutory bodies, managed-healthcare providers, restaurant franchisees, sporting organisations and sub-contractors in large infrastructure projects. This has given her wide exposure to a broad range of industries – and to all of the different regulatory regimes that govern such businesses.
Out of the corporate realm, she has advised schools and a number of individuals in pro-amico and pro-bono matters. She has a special interest in public law.
Kara has a BA from the University of the Witwatersrand and an LLB from the University of South Africa.
