Overview

Cobus is admitted as an attorney of the High Court of Namibia. He is also an attorney of the Supreme Court of Namibia and a notary public.

He concentrates primarily on complex general commercial litigation in the High Court and Supreme Court, with sub-specialisation areas in insolvency law, construction dispute resolution and administrative reviews in both the High Court and in terms of public procurement legislation. In his years of practice, Cobus has been involved in several high-profile administrative review, liquidation and judicial management matters in the High Court and the Supreme Court, many of which have been published in the Namibian Law Reports.

Experience

  • Acting on behalf of a group of major foodstuffs companies and is currently involved in a number of administrative review applications before the Namibian Procurement Review Panel and the High Court of Namibia. He was recently involved in an administrative review application before the High Court which successfully set aside a decision by the Namibian Central Procurement Board to cancel a public procurement bid titled Procurement of Supply Foodstuffs to Government School Hostels, exceeding N$ 3,5 billion in value.
  • Acting on behalf of a group of major foodstuffs companies in an action instituted against the Tender Board and Government of Namibia (currently pending before the Supreme Court of Namibia) claiming damages of approximately N$ 140 million.
  • Acting on behalf of a major international foodstuffs retailer in a number of matters in the High Court and Supreme Court ranging from the institution of urgent perfection applications, liquidation applications and action proceedings in which the claim value ranges from N$ 400,000 to approximately N$ 90 million in value.
  • Acting on behalf of the liquidators appointed for Green Property Investment One Hundred and One (Pty) Ltd (formerly known Jimmey Construction (Pty) Ltd) with a reported estimated asset value of N$ 1 billion; and the provisional judicial manager for Omeya Golf Residential Oasis (Pty) Ltd and its subsidiaries, an insolvent estate with an estimated asset value in excess of N$ 300 million.
  • Acting on behalf of some of the most prominent architectural firms in Namibia in various actions (some of which exceed N$ 40 million and N$ 90 million in claim value) before the High Court.
  • Acting on behalf of the Namibia National Olympic Committee & Commonwealth Games Association before the High Court (successfully defended) and in the Supreme Court of Namibia which matter deals with the law of collateral challenge.
