Overview
Andrew Pike is the Senior Consultant in our Project Finance practice.
He has acted for numerous clients in due diligence investigations, risk assessments and transactional work in the ports, transport and logistics sector. His expertise covers legal structuring, contractual and transactional issues and service agreements. He also drafts and reviews regulations, concessions, trading terms and throughput agreements, and drafts and comments on, South African transport legislation. He has also been involved in shipping and ports litigation for most of his working life. He conducts shipping training and lecturing from time to time for various industry bodies. Andrew is frequently invited to speak at local and international conferences on a variety of subjects.
Experience
Andrew has executed and participated in extensive contentious and non-contentious matters in Africa south of the Sahara, some of which include and relate to:
- 35 years experience in ports, transport (focused on shipping, but including rail and road), petrochemicals and logistics, including extensive commercial advice, contractual support and litigation experience.
- Lead Local Counsel in respect of the development, financing and operation of an off-shore marine supply base project at Saldanha Bay.
- Establishment of LPG storage facilities and related logistics at Richards Bay.
- Relocation of liquid bulk storage facilities from the port of Port Elizabeth to the Special Economic Zone of Coega, port of Ngqura.
- Transaction advisor to MSC Cruises S.A., the sponsor of the new cruise terminal in Durban, advising on both the bid and all aspects of the implementation of the concession.
- Viability study and PPP transaction advisory services (legal and risk assessment) for the proposed new Durban dig-out port.
- Legal advisor (ports and shipping) to the sponsor of a LNG project in Matola, Mozambique.
- Ports regulatory advice on the recent award of the emergency power tenders in South Africa.
- Port and logistics study in Nigeria.
- Local Counsel to the preferred bidder in the Port of Durban RFP for the part privatization of Durban Container Terminal, Pier 2.
- Extensive logistics advice and contractual support to a major logistics group in connection with dry bulk transport corridors and gas exploration.
- Feasibility, legal and operational structuring, for a proposed railway transport system and port coal terminal in Mozambique.
- Due diligence study (port and terminal sector, commercial and legal) in respect of a multi-national (listed company) port and terminal operator and logistics provider.
- Transaction advisor on marine transport project in the Great Lakes region.
- Legal structuring, contractual and transactional advice for the liquid bulk storage and handling complex in Durban.
- Drafting and review of bulk terminal regulations, trading terms and throughput agreements for at several bulk handling terminals.
- Ports economic regulation as a Board Member of the Ports Regulator of South Africa for five years.
- Extensive risk assessment facilitation and providing risk management training in petrochemical and mobile telecoms industries.
