Alfred Deya is a senior associate in our Nairobi office in the Dispute Resolution department.

He specialises in Dispute Resolution, Employment Law, Constitutional Law, Environment & Land Law, Commercial Law and Intellectual Property.

Alfred has an LLB from Moi University and a Postgraduate Diploma from the Kenya School of Law and is currently pursuing a master’s degree in law, in Corporate Governance, from the University of Nairobi.

He is an admitted advocate of the High Court of Kenya and a member of the Law Society of Kenya.

Experience

  • Alfred’s knowledge and experience in dispute resolution and litigation are relatively extensive, spanning over nine (9) years. This is demonstrated by the fact that he has appeared before all Courts and Tribunals in Kenya and represented clients in very contentious disputes.
  • In Land Law matters, I represented Kenya Railways Corporation to reclaim a prime property within the Nairobi Central Business District which had been invaded by squatters. The Court in making an eviction order against the squatters set out guidelines to use in effecting evictions. This decision has become the locus classicus in eviction cases. *
  • In Employment law matters I have a theoretical and practical grounding in employment law. I have prepared high-level advisories to clients ranging from termination of employment under Kenyan law (Mastercard), discrimination, and sexual harassment at the workplace (Victory Farm Kenya Limited), registration of trade unions and employer-trade union relationships (Technoserve Inc), whether bonus payment to employees is a contractual or legal right (Microsoft East Africa Limited), and generally on employee rights to annual leave, sick leave, working hours under Kenyan law, etcetera (Technoserve Inc).
  • I have handled employment claims touching on the violations of an employee’s right to fair labour practices under Article 41 of the Constitution and to equality at the workplace and freedom from discrimination under Article 27 of the Constitution (Samasource EPZ Kenya Limited).
  • I have defended many other employment claims in relation to claims of unfair, unlawful, and wrongful termination of contracts of employment (Vitafoam Limited, Habitat for Humanity International, Inc, Air Connection Limited, Airtel Networks Kenya Limited, etc).
  • In Commercial law-related matters, I have represented ABSA Bank, Equity Bank of Kenya* and Kenya Commercial Bank* in enforcing charged instruments under a Chargee’s power of sale where the chargors sought to restrain the institutions’ right to exercise the power of sale under section 90 of the Land Act.
  • Part of a team that successfully defended Bavaria N.V. in a distributorship agreement dispute between Bavaria N.V. and Jovet Kenya Limited.
  • In Civil dispute claims, I have represented and defended ABSA Bank in defamatory claims for its listing of customers with a Credit Reference Bureau and alleged uttering of defamatory statements. *
  • Part of a team that has advised Mombasa Gas Terminus on steps to take in settling claims of an ongoing environmental dispute before the National Environmental Tribunal.
