Overview

  • On 6 October 2023, the Tanzanian Mining (State Participation) (Amendment) Regulations (Amendment Regulations) were published amending the Mining (State Participation) Regulations (State Participation Regulations).
  • Regulation 2 of the Amendment Regulations has introduced a penalty for non-compliance with the State Participation Regulations by mining companies or any person holding a mining licence or special mining licence.
  • Penalties for non-compliance include either a suspension in, or cancellation of, a licence.

On 6 October 2023, the Mining (State Participation) (Amendment) Regulations were published via Government Notice No. 722 of 2023 (Amendment Regulations) amending the Mining (State Participation) Regulations, 2022 (State Participation Regulations).

Regulation 2 of the Amendment Regulations has introduced a penalty for non-compliance with the State Participation Regulations by mining companies or any person holding a mining licence or special mining licence by adding a new Part VII to the State Participation Regulations (default provision).

A mining company or person holding a mining licence or special mining licence who fails to comply with the requirements stipulated under the State Participation Regulations will be in default and will be subjected to either a suspension or cancellation of their licence under the provisions of section 63 of the Mining Act, Cap. 123 (as amended).
