On 17 June 2015, the Competition Appeal Court (“CAC”) upheld the appeal by Sasol Chemical Industries Ltd (“Sasol”) against the decision by the Competition Tribunal (the “Tribunal”) that Sasol charged excessively for propylene and polypropylene between 2004 and 2007. In terms of section 8(a) of the Competition Act, it is prohibited for a dominant firm to charge an excessive price to the detriment of consumers. An “excessive price” is a price which bears no reasonable relation to the economic value of that good or service.
