The Competition Commission (the “Commission“) has published its Draft Guidelines on the Assessment of Public Interest Provisions in Merger Regulation under the Competition Act (the “Draft Guidelines“) for comment by 23 February 2015. The Draft Guidelines seek to provide guidance on the Commission’s analysis of mergers by indicating the Commission’s likely approach and the type of information the Commission may require when evaluating the public interest considerations in terms of section 12A(3) of the Act.
