Bowmans acted for the South African Breweries (Pty) Ltd (SAB) in defending a ZAR41 million claim for damages brought by one of its Carrier Contractors arising out of a Primary Distribution Agreement (PDA). The Contractor’s claim was based on an alleged unlawful cancellation of the PDA by SAB. The matter was referred to arbitration before Adv Schalk Burger SC and the arbitrator found in favour of SAB and held that SAB’s cancellation of the PDA was valid. The Contractor was also ordered to pay the costs of the arbitration spanning over the last three years.
